All Skirmish bookings are sold subject to availability and to these terms and conditions. These terms and conditions should be read prior to purchase as purchasing a skirmish constitutes acceptance of these terms and conditions.
1. BOOKINGS & ADMITTANCE
1a. A valid Booking must be confirmed by each Customer to gain entrance to a Skirmish upon arrival. Failure to produce evidence of a paid booking may result in expulsion from the Skirmish.
1b. It is the Customer’s responsibility to check their booking. Hockley Airsoft Arena Ltd will make all reasonable endeavours to correct mistakes if brought to their attention prior to the Skirmish for which the booking was intended for.
1c. It is the Customer’s responsibility to ascertain whether a Skirmish has been cancelled or rescheduled. In such cases Hockley Airsoft Arena Ltd will make all reasonable endeavours to notify Customers of the change, but cannot guarantee all will be informed before the date of the Skirmish.
1d. It is the Customer’s responsibility to assess the suitability of a Skirmish for participants.
1e. It is the responsibility of all customers to ensure they have read and signed a Participation Consent Form prior to playing. All participants under the age of 16 must have parental/guardian permission to play. Hockley Airsoft Arena Ltd reserves the right to refuse entry if a participation form cannot be produced, in the case of under age participants signed by parent/guardian.
1f. Hockley Airsoft Arena Ltd reserve the right to refuse entry to customers who refuse to sign a Partcipation Consent Form or refuse to agree for this information to be retain for 3 years, under GDPR regulations, inaccordance to Hockley Airsoft Arena Ltds insurance.
1g. It is the responsibility of Hockley Airsoft Arena Ltd to ensure customer details are updated and retained in accordance with current Data protection laws.
2. CONDITIONS OF ADMISSION
2a. Hockley Airsoft Arena Ltd reserves the right to refuse admission to a Customer, or to eject them from Hockley Airsoft Arena at any point, if in the managements’s reasonable opinion the Customer: is acting in a threatening or aggressive manner; uses threatening, abusive or insulting language; appears to be under the influence of alcohol and/or drugs; may be a risk to the safety of staff or other Customers; may detract from the enjoyment of other Customers; fails, when required, to produce proof of identity or age; fails to comply with instructions given by the Hockley Airsoft Arena Ltd’s staff; or is found to be in breach of these terms and conditions or statutory law. No refunds will be given to Customers who are refused entry or ejected due to their behaviour as suggested in, but not limited to, the examples detailed previoiusly.
2b. Hockley Airsoft Arena Ltd will endeavour to admit latecomers at the first suitable opportunity, this will not be until any personal weapons have been Chrono’d and the safety briefing has been given. For some Skirmishes late admission cannot be guaranteed.
2c. Customers should arrive 30 minutes before the official start time, especially if they have weapons to chrono or forms to complete. Hockley Airsoft Arena Ltd reserves the right to start the skirmish on time even if all customers are not ready. Late customers will be required to chrono their weapons after the safety briefing and wait to join the skirmish.
2d. Hockley Airsoft Arena Ltd reserves the right to conduct security searches and confiscate any item which, in the reasonable opinion of the management, may cause danger or disruption to the Arena, Skirmish, Staff or other Customers.
2e. It is the customers resposibility to inform Hockley Airsoft Arena Ltd staff if they have any known medical conditions which may be affected by stroboscopic lighting or loud noises.
3. BOOKING CANCELLATIONS, EXCHANGES & REFUNDS
3a. Skirmish bookings are not eligible for a refunded after purchase unless the Skirmish is cancelled, abandoned, rescheduled or where there is a material change to the Skirmish. A material change is a change which, in Hockley Airsoft Arena Ltd’s reasonable opinion, would make the Skirmish materially different to the Skirmish that the purchasers of the booking could reasonably expect.
3b. Refunds shall only be made to the person who purchased the Skirmish and, where possible, by the same method used to purchase the Skirmish. When it is not possible to refund via the same payment method Hockley Airsoft Arena Ltd reserves the right to request additional identification or documentation to ensure the money is returned to the correct person.
3c. In the case of a cancelled Skirmish, Customers will be refunded the face value of the Skirmish and any associated equipment hire.
3d. In the case of a postponed/rescheduled Skirmish, Customers will be offered alternative bookings of the same value for the new date/time, subject to availability. Where it is not possible to offer a booking of the same value then alternative Tickets may be offered. Should the Customer not wish to accept this booking then a refund can be obtained for the face value of the booking and any associated hire fees.
3e. If a Skirmish is abandoned after commencing Customers will be offered, subject to availability, equivalent value bookings for an alternative Skirmish or they will be refunded the face value of the booking and any associated hire fees they have paid.
3f. Hockley Airsoft Arena Ltd reserves the right to cancel bookings which they reasonably suspect to have been booked fraudulently.
3g. At Hockley Airsoft Arena Ltd’s discretion, a waiting list may be kept for sold out Skirmishes to assist Customers who can no longer attend. Hockley Airsoft Arena Ltd withholds the right to charge an administration fee for facilitating the transfer of bookings from one Customer to another.
4. SKIRMISH PRICES
4a. Skirmish prices are subject to change. Hockley Airsoft Arena Ltd reserves the right to change the prices of Skirmishes and/or introduce discounts/special offers which cannot be retrospectively applied to Skirmishes already purchased.
4b. All discounts/special offers are offered subject to availability and therefore Skirmishes may not be available at all advertised prices at all times.
4c. Concession/discounted Skirmish prices must be applied for at the time of purchase and cannot be applied to Skirmishes already purchased. Proof of entitlement to a concession/discount may be requested from the Customer at the time of booking and/or when they attend the Skirmish. Failure to produce reasonable proof of entitlement to a concession/discount may invalidate the booking and result in refusal of admittance or ejection from the Airsoft Arena.
4d. Concessions/discounts are offered individually and cannot be used in conjunction with one another. If a Customer is eligible for multiple concessionary/discounted rates then they will receive the cheapest singularly discounted price, not a cumulatively reduced price.
5. PROHIBITIONS & CUSTOMER CONSENT
5a. The unauthorised resale, or attempted resale, of a Skirmish booking for financial gain is prohibited. Hockley Airsoft Arena Ltd reserves the right to cancel Tickets which it reasonably suspects as being offered for unauthorised resale.
5b. The use of equipment to record or transmit audio and/or visual material inside the Airsoft Arena is permitted. However, Hockley Airsoft Arena Ltd reserves the right to use any footage uploaded to any public domain and retain copyright.
5c. By attending the Skirmish Customers give their consent to filming, photography and sound recording of themselves as participants of the Skirmish. Hockley Airsoft Arena Ltd will own the copyright of such material and may use such films/photographs/recordings for any purpose, including commercial purposes, without payment or further notification.
5d. The use of electronic cigarettes is prohibited throughout Hockley Airsoft Arena.
6. GIFT VOUCHERS
6a. Gift vouchers can be redeemed in full or in part to purchase Tickets for participating Skirmishes in person or by telephone.
6b. Gift vouchers expire 6 months after the purchase date. Expired vouchers cannot be redeemed or refunded. The expiry date is clearly printed on all vouchers.
6c. Gift vouchers cannot be exchanged for cash.
6d. Customers have the right to return unused gift vouchers within 14 days of purchase; qualifying vouchers which have been partially redeemed within this time period will be eligible for a partial refund equal to the unused value of the vouchers; after 14 days of purchase gift vouchers are non-refundable.
7. MEMBERSHIPS
7a. Customers have the right to cancel membership within 14 days of purchase, after which time the membership is non-refundable. If benefits of a membership are used prior to cancelling it Hockley Airsoft Arena Ltd reserves the right to withdraw and reverse the benefits you have gained. Skirmish prices discounted for members may be rebooked at full price and the difference in cost deducted from the refund.
7b. Memberships are valid for a twelve month period.
7c. Hockley Airsoft Arena Ltd reserves the right to amend the cost of the membership and the benefits it provides without prior warning.
7d. Members found, or reasonably suspected of, reselling their bookings for commercial gain may have their membership terminated without recompense.
7e. Memberships purchased by Direct Debit will be automatically renewed upon their expiry. Customers must provide notification in advance of the expiry date to cancel the renewal of the membership subscription. This does not affect your rights in accordance with the Direct Debit Guarantee.
8. LIABILITY
8a. Hockley Airsoft Arena Ltd will not be responsible for any injury or loss, theft or damage of Customer’s personal belongings, other than that caused as a result of negligence or other breach of statutory duty.
8b. Personal arrangements, including but not limited to, travel, accommodation and subsistence relating to the Skirmish are made entirely at the Customer’s own risk and Hockley Airsoft Arena Ltd shall not be liable for any losses incurred from these arrangements.
8c. Nothing in these terms and conditions seeks to exclude any liability of the Venue for death or personal injury caused by its negligence or other type of liability which cannot by law be excluded or limited.
8d. These terms and conditions are governed by English Law and any disputes which may arise with Hockley Airsoft Arena Ltd are subject to the exclusive jurisdiction of the English Courts.
9. DEFINITIONS
‘Booking’
means any payment made in purchase of a Skirmish, which confers the right to attend a Skirmish.
‘Customer’
includes both the person who purchased, or intends to purchase, Skirmish booking, a gift voucher or a membership, and those within his or her party who are attending the Skirmish, each of whom must possess a valid booking.
‘Hockley Airsoft Arena Ltd’
means any location where the Skirmish organised by Hockley Airsoft Arena Ltd is being held and representatives of this location including but not limited to the management, security and marshalling teams.
‘Skirmish’
means any Skirmish occurring at the Hockley Airsoft Arena Ltd in respect of which bookings are sold.
‘Participation Consent Form’
consenting mandatory form to be signed by all participants before participating in their initial skirmish.
